BurkeApp Terms of Use

1. Acceptance of Terms

By downloading, installing, or using BurkeApp ("the Application"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Application.

2. Description of Service

BurkeApp is a desktop streaming tool operated by BurkeBlack that provides real-time stream analytics, chat monitoring, sentiment analysis, and performance metrics. The Application integrates with third-party services, including the YouTube Data API, to gather live chat and stream data.

3. Google API Services

BurkeApp uses the YouTube Data API to access YouTube Live chat messages and broadcast data. By using features that rely on Google API Services, you also agree to be bound by the Google Terms of Service. Your use of data obtained through Google APIs is subject to our Privacy Policy and the Google API Services User Data Policy, including the Limited Use requirements.

4. User Accounts and Authentication

Certain features of BurkeApp require you to authenticate with your Google account via OAuth. You are responsible for maintaining the security of your account credentials. You may revoke BurkeApp's access to your Google account at any time through your Google Account Permissions.

5. Permitted Use

You agree to use BurkeApp only for its intended purpose and you will not:

• Use the Application for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse engineer, decompile, or disassemble the Application.
• Use the Application to harass, abuse, or harm others.
• Attempt to gain unauthorized access to any systems or data connected to the Application.
• Redistribute, sublicense, or resell the Application without prior written consent.

6. Intellectual Property

BurkeApp and all related content, features, and functionality are owned by BurkeBlack and are protected by applicable intellectual property laws. These Terms of Use do not grant you any rights to use the BurkeBlack name, logo, or trademarks.

7. Disclaimer of Warranties

BurkeApp is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Application will be uninterrupted, error-free, or free of harmful components. Your use of the Application is at your sole risk.

8. Limitation of Liability

To the fullest extent permitted by law, BurkeBlack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of BurkeApp, including but not limited to loss of data, revenue, or profits.

9. Termination

We reserve the right to suspend or terminate your access to BurkeApp at any time, with or without cause, and with or without notice. Upon termination, your right to use the Application will immediately cease.

10. Changes to These Terms

We may update these Terms of Use from time to time. Any changes will be posted on this page with an updated revision date. Continued use of BurkeApp after any changes constitutes acceptance of the updated terms.

11. Privacy

Your use of BurkeApp is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
